Knavery actions have been one of the oldest problems since the existence of societies living together. Nowadays, it has increased significantly in relation with the increase of the population and technological developments. Therefore, increasing importance of the crime and new approaches and applications in the doctrine of the structure of the crime necessitate a study like this. The thesis is consisted of three chapters. In the first chapter, the definition and history of knavery is told and its role in comparative law is investigated, the offence and the values are noted and subsequently offender and victim are discussed. In the second chapter, material elements of the offence are studied and some examples of crimes are compared. The last chapter points out 5 main topics as inducement of the offender, aggravating circumstances , the means used, usage of occupational activities, and the type of cheating and in this chapter appearance, sanction and proceeding are noted. In the study, while there is an explanation about the offence of knavery, Turkish Penal Code No. 5237 and the amendments in the law are noted. On the other hand, by taking the approaches and decisions into consideration, we conclude that some legal regulations are needed targeting the problems related to some judicial deficiencies and uncertainty in the crime factors of knavery.
