Article Violation of Public Policy as a Ground for Annulment of an Arbitral Award Within the Context of Arbitration Proceedings Conducted Pursuant to the Code of Civil Procedure(Istanbul Univ, Fac Law, 2025) Tanriver, SuhaThe subject of this study is the violation of public policy, which constitutes one of the most significant grounds for setting aside an arbitral award within the framework of arbitration proceedings conducted under the provisions of the Turkish Code of Civil Procedure. In this context, it is first demonstrated that it is difficult to provide a precise definition of public policy due to its variable nature depending on time and place. Classifications proposed in relation to this concept are addressed, and by taking into account scholarly opinions and especially judicial practice, it is determined that a violation of public policy, as a ground for setting aside, refers to contradictions with the body of institutions and rules that protect the fundamental structure and core interests of Turkish society at a given point in time. Subsequently, individual cases considered as violations of public policy-particularly in light of court decisions-are examined, and specific issues often associated with such violations are analyzed and critiqued. Finally, the study emphasizes that the determination of a violation of public policy lies within the discretion of the court, depending on the particular circumstances and features of the case. It is also noted that, even if not explicitly raised in the statement of claim for annulment, the court may consider this issue ex officio, and the related review-albeit to a limited extent-permits substantive scrutiny of the arbitral award.Article Citation - WoS: 1The Associations Between Sleep Problems, Parental Attitudes, and Behavioral Problems in Preschool Children(Galenos Publ House, 2025) Torun, Naksidil Yazihan; Sayinta, Senanur; Kocak, Hatice Nur; Kilic, Kizbes Meral; Yazıhan, NakşidilObjective: This study aims to examine the relationships between preschool children's sleep characteristics, social competence, behavioral problems, and parental attitudes and focus specifically on how preschool children's sleep mediates the relationship between parental attitudes and children's social competence and behavioral problems. Materials and Methods: This study's sample consisted of 142 parents of preschoolers. Data were collected using the "Demographic Information Form", "Children's Sleep Habits Questionnaire", "Social Competence" and Behavior Evaluation Scale-30, and Parenting Attitude Scale. Results: Significant moderate correlations were found between sleep habits, parental attitudes, and children's behavioral-emotional problems. The mediatory role of sleep duration and sleep anxiety of the children between democratic parental attitude and social competence was also significant. The mediators (sleep duration and sleep anxiety) accounted for part of the pathway through which democratic parenting affects social competence. Conclusion: This study emphasizes the pivotal role of parental attitudes in influencing children's sleep-related difficulties and daytime behavioral problems. Effective management of sleep anxiety and sleep duration in children has the potential to enhance their behavioral and emotional outcomes.Article Citation - WoS: 5The Emergence, Institutionalization and Consequences of National Management and Organization Congresses in Turkey(Eskisehir Osmangazi Univ, Fac Education, 2009) Ozen, Sukru; Kalemci, ArzuIn this study, the emergence, institutionalization, and consequences of National Management and Organization Congress (NMOC) in Turkey are examined from the new institutionalist perspective. Based upon the interview data collected from the main actors who play crucial roles in the emergence and structuring of the congress, it is examined how the congress was initiated, and structured, and how the conference influenced the management and organization field in Turkey. It is found that the congress was initiated by a group of academics who shared the logic of "scienticism" in the field, and were dissatisfied with the boundaries and outcomes of the traditional logic prevalent in the field. The congress was also structured and legitimated by this group by inspiring from the American and European models, and mobilizing the participation of the crucial actors who represented the traditional logic. It is also found that the congress influenced the identity of the field, the quantity and quality of researches in the field and triggered other congresses in the field.Article Citation - WoS: 1The Association of Probable Adhd With the Increase in Video Gaming and the Disordered Gaming Symptom Severity During Covid-19 Pandemic in Turkey(Yerkure Tanitim & Yayincilik Hizmetleri A S, 2021) Evren, Cuneyt; Evren, Bilge; Dalbudak, Ercan; Topcu, Merve; Kutlu, NilayObjective: The objective of the study is to examine the association of probable attention deficit hyperactivity disorder (ADHD) with the increase in video gaming and the severity of disordered gaming symptoms among young adults during the COVID-19 pandemic restrictions. The second objective was to examine the mediating role of COVID-19 related dysfunctional anxiety and current age. Methods: The Adult ADHD Self-Report Scale (ASRS-v1.1), the nine-item Internet Gaming Disorder Scale- Short Form (IGDS9-SF), and the Coronavirus Anxiety Scale (CAS) were used to evaluate university students. Results: Participants with probable ADHD (n=117, 21.2%) did not differ in terms of age, gender, romantic relationship, and employment status when compared with participants without probable ADHD (n=441, 79.0%). However, they had higher scale scores (IGDS9-SF and CAS). In the hierarchical logistic regression analysis, probable ADHD predicted the increase in video gaming during the pandemic, but when the current age and the dysfunctional anxiety related with COVID-19 were included in the analysis, they were significant predictors, whereas probable ADHD was no more a predictor. While probable ADHD was associated with the symptom severity of disordered gaming in ANCOVA, COVID-19 related dysfunctional anxiety was a significant covariate. Conclusion: Findings of the current study may suggest that the relationship between probable ADHD and the increase in video gaming during the pandemic was mediated by lower age and COVID-19 related dysfunctional anxiety among young adults. Additionally, while COVID-19 related dysfunctional anxiety was a significant covariate for the severity of disordered gaming symptoms, probable ADHD was independently associated with the symptom severity of disordered gaming.Article The Reconciliation of Nethnography and Its Application in Marketing Research(Mehmet Akif Ersoy Univ, 2022) Nakip, Mahir; Gokmen, AytacNetnography is the application of ethnography in the virtual environments. One can say that netnography is a special application of virtual means to social interaction which is an unprecedented ethnographic research framework. Nethnography is a special research method that the application of virtual means to ethnographic studies. Ethnography is a qualitative research technique to researches cultural behaviors related in the social environments. It aims at who the targeted population is, what their story is and their experiences. Nethnography depends on ethnography which have the same principles. It is natural, participative and applicable. Nethnography is based on online participative and descriptive research that includes texts, videos and photographs. Thus, the aim of this study is to extensively research the concept of nethnography, which stems from ethnography and express to the target audience the concept comprehensively..Article Historical Development of Foundation Universities From Organizational Ecology Perspective(Tuba-turkish Acad Sciences, 2024) Sener, Irge; Karapolatgil, Ahmet AnilIn this study, the diversification and spread of Foundation Universities, which have been providing higher education for nearly 40 years in our country, T & uuml;rkiye has been examined descriptively within the frame of organizational ecology theory. The qualifications of the founding foundations of the 74 Foundation Universities, which are continuing education since the first Foundation University started education in 1984, have been examined in the historical process until 2022 yearend. It has been evaluated that the conditions of the period in which the Universities were founded caused their diversification; and five different periods were determined according to the foundation dates of the Foundation Universities. While the increase in the number of Foundation Universities was low in some periods, it was determined that there was a high increase in other periods. In addition, according to the characteristics of the Founding Foundations, a classification was made for Foundation Universities under six different categories as; "educator", "investor", "medical education focus", "collective organization", "public nature" and "association". Currently, investor category universities outnumber those in other categories. Another issue identified in the study is that the Founding Foundations tend to preserve the imprinting of their qualifications. In addition, in line with the stagnation in the number of newly opened Foundation Universities in recent years, it has been evaluated that the number of Foundation Universities in metropolitan cities has reached saturation. However, it is considered likely that Foundation Universities with different imprinting characteristics will be established in the future.Article Understanding of Business Ethics in Nations Through a Comparison of American and Turkish Business Ethics Literature(IGIAD-Turkish Entrepreneurship & Business Ethics Assoc, 2024) Kocaömer, Neslihan; Kalemci, R. Arzu; Ozkan, IlaydaThis study aims to contribute to field studies by discussing how the sources of hypernorms in different countries with different cultural contexts affect different understanding of business ethics based on a content anal- ysis of articles published in Turkey and the United States of America retrieved from academic databases querying ‘business ethics’ in their titles. Results for Turkey show that the historically- and culturally-rooted understanding of sovereign state manifests itself both in its national business system, paternalistic features and a high-power-dis- tance society. As a result of the sovereign state ideology, the dominant local economic community in Turkey is the state which can lay down ethical norms for its members through micro-social contracts. This ultimately lays the groundwork for the emergence of a context-specific business ethics approach. By contrast, the dominant local economic community seems to be the corporations in the USA where the micro-social contract may include that establishing strong ethical principles is the responsibility of corporations as the state does not fully regulate the relationship between individuals and businesses.
