    “Cesetsiz Öldürme Suçları İspatlanabilir Mi?” Anglo-Amerikan İspat Hukuku İle Karşılaştırmalı Yargıtay Kararlarının Analizi

    Cesetsiz cinayet vakaları (NBH), bir cinayet olayında mağdurun (cesedinin) gizlendiği ya da yok edildiği, diğer bir ifadeyle ortada bir cesedin bulunmadığı; ancak bir cinayet şüphesinin bulunduğu olaylardır. Bu olaylara ilişkin yargılamalarda, vakıanın kuşkusuz en önemli delilleri arasında bulunan mağdurun cesedinin ya da cesedinin bir parçasının bulunamamasına rağmen, kişi veya kişiler hakkında mahkûmiyet kararı verilmesi mümkün müdür? Yoksa çok yaygın bir inanışın yansıması olarak “ceset yoksa cinayet de yoktur” şeklinde bir kaide gerçekten söz konusu mudur? Mahkemenin cesedin olmamasına rağmen, mahkûmiyet kararı verebileceğinin kabulü halinde karara hangi delil ya da delillere dayanılarak hükmedilebilecektir? Vakıanın büyük ölçüde çözülmesini sağlayabilecek mağdurun cesedi gibi bir delilin yokluğunda mahkemenin ya da hâkimin mahkûmiyet kararı verebilmesi için yenmesi gereken şüpheyi yendiğinden tam olarak söz edilebilecek midir? Ceza muhakemesi hukukunun tarihsel anlamda en önemli kazanımlarından biri olan masumiyet karinesinin ve bu karinenin bir uzantısı olan şüpheden sanık yararlanır ilkesinin böyle durumlarda gündeme gelmesi mümkün müdür ve/veya gerekli midir? Cesedinin bulunamadığı düşünülen ve öldüğü sanılan mağdurun yargılamanın hatta infazın tamamlanmasının ardından bir anda sağlıklı bir şekilde ortaya çıkması durumunda ne olacaktır? İşte bu çalışmanın konusunu da yukarıda sorduğumuz pek çok soruyu cevaplamaya çalışacağımız mukayeseli hukukta “no body homicide” olarak kavramlaştırılan cesetsiz öldürme olaylarında ispatın de lege lata (olan hukuk) yönünden ne şekilde gerçekleştiği ve de lege ferenda (olması gereken hukuk) bakımından ise ne şekilde gerçekleşmesi gerektiğine ilişkin tartışma oluşturmaktadır.

    Analysis of Short-Circuit Impedance in Multi-Winding Transformer

    Due to green energy policies, investments in renewable energy are rapidly increasing, which in turn raises the demand for efficient power plant integration into electrical grids. Multi-winding distribution transformers are crucial in this process, as they enable operation at various voltage levels to match different grid requirements. However, designing such transformers, mainly calculating short-circuit impedance in accordance with industry standards, is a highly complex and challenging task when using conventional analytical methods. This study investigates the short-circuit impedance of a multi-winding transformer and presents an efficient approach to accurately calculating the short-circuit impedance. The study uses Finite Element Method simulations to calculate the short-circuit impedance for different winding configurations. Experimental testing is performed on a prototype transformer to validate the results, ensuring its performance and reliability. The proposed method offers researchers and manufacturers a reliable approach to accurately determine short-circuit characteristics, improving transformer design and reducing reliance on costly test processes. This approach supports the determination of the necessary characteristics of the transformer before producing prototypes

    Widths and Entropy of Sets of Smooth Functions on Compact Homogeneous Manifolds

    We develop a general method to calculate entropy and n-widths of sets of smooth functions on an arbitrary compact homogeneous Riemannian manifold Md . Our method is essentially based on a detailed study of geometric characteristics of norms induced by subspaces of harmonics on Md . This approach has been developed in the cycle of works [1, 2, 10–19]. The method’s possibilities are not confined to the statements proved but can be applied in studying more general problems. As an application, we establish sharp orders of entropy and n-widths of Sobolev’s classes Wγ p ( Md ) and their generalisations in Lq ( Md ) for any 1 < p, q < ∞. In the case p, q = 1, ∞ sharp in the power scale estimates are presented.

    Demiryolu Sektörü Doğal Tekel mi: Türkiye Cumhuriyeti Devlet Demiryolları (TCDD) Üzerine Ampirik Çalışma

    This paper analyses whether the Turkish railway industry possesses features indicative of a natural monopoly. For this purpose, we utilize subadditivity analysis to assess and compare the efficiency levels of TCDD under monopoly conditions with hypothetical duopoly scenarios, considering the time span from 1990 to 2016. Our findings reveal that the cost function displays subadditivity for all configurations within the permissible range, confirming TCDD's classification as a natural monopoly before the separation in 2016. This suggests that a decrease in production costs is improbable when two firms engage in activities within the Turkish railway sector. Given that a natural monopoly with a single company may result in prices surpassing socially desirable levels, it becomes imperative for policymakers to enact regulations that simultaneously safeguard consumers and maintain the integrity of the natural monopoly within the railway sector. Striking a careful balance between ensuring affordability, accessibility, and efficiency is essential while preventing potential monopolistic abuses.

    Critical Aspects, Motivators and Barriers of Building-Integrated Vegetation

    Purpose Green buildings which provide improved user health conditions and environmentally responsible applications have gained significant attention, due to the increasing environmental problems, particularly caused by the construction industry at the global scale. However, vegetation is still not sufficiently integrated into buildings, even though numerous benefits of plants have been proven by many studies in literature. This research aims to find out the opinions of professionals and academicians in architecture-related fields regarding the critical aspects, as well as the motivators and barriers faced in BIV applications, namely; green roofs, green walls and interior gardens. Hence, it strives to help increase their application rates by underlining the significant issues to be considered. Design/methodology/approach As to fulfilling these objectives, a questionnaire survey was conducted on 120 participants with varying professions including architects, landscape designers and civil engineers, from four countries. Findings The results of this study pointed out that, healthcare buildings were given the first priority among the building types for applying BIV. Moreover, among the motivator factors, receiving a certificate was found as an important incentive, besides the environmental, social and economic benefits of BIV. Furthermore, although the highly rated barriers were found as 'the lack of proper regulations' and 'lack of demand by the user/client', the findings showed that the highest responsibility for the implementation of these applications was placed on the architect. Research Limitations/Implications Based on the five major groups of Koppen climate classification system, the case countries were selected as one from each of the four main types, and by neglecting only Polar, as it lacks settlements. By considering diverse levels of development and economic welfare, countries were selected as; Canada (Snow: Humid-Subarctic), Libya (Dry: Desert-arid), Malaysia (Tropical: Tropical-Rain forest) and Turkey (Mild temperate: Mediterranean). Since the study covered four different countries, the survey was conducted by the use of Google Forms software program. This tool enabled the production and distribution of questionnaires, as well as the collection of data based on the responses of the participants. Furthermore, in order to provide consistency among the questionnaires applied in different countries, the survey was conducted in English language, although it was not the native language for a majority of the participants. Moreover, based on studies claiming that participants are more inclined to select the option with the mid-value in a Likert scale, which implies a neutral position, in the questionnaire, these types of questions were constructed with the forced choice method, by keeping the scales with even number of options. Practical Implications It is expected that the results of this study would be beneficial to both the academicians and professionals involved in the green building industry, as well as to the governmental and/or green building authorities. It is expected that this study will help serve as a guide for the stakeholders to increase the application rates of BIV in the construction industry. Social Implications The results of this study were also evaluated based on the findings of four case countries and certain conclusions were derived as to their underlying socio-economic and geographical reasons. Originality/value - Although studies on similar subjects have appeared in the literature, there are none which solely focuses on BIV applications by conducting a survey on the mentioned four case countries and compares its findings with the literature and presents an in-depth analysis on the issue.

    An Algebraic Stability Test for Fractional Order Time Delay Systems

    In this study, an algebraic stability test procedure is presented for fractionalorder time delay systems. This method is based on the principle of eliminatingtime delay. The stability test of fractional order systems cannot be examineddirectly using classical methods such as Routh-Hurwitz, because such systemsdo not have analytical solutions. When a system contains the square roots ofs, it is seen that there is a double value function of s. In this study, a stabilitytest procedure is applied to systems including ps and/or different fractionaldegrees such as s where 0 < α < 1, and αǫR. For this purpose, the integerorder equivalents of fractional order terms are first used and then the stabilitytest is applied to the system by eliminating time delay. Thanks to the proposedmethod , it is not necessary to use approximations instead of time delay termsuch as Pad´e. Thus, the stability test procedure does not require the solutionof higher order equations.

    7405 Sayılı Spor Kulüpleri ve Spor Federasyonları Kanunu Çerçevesinde Denk Bütçe Zorunluluğu

    7405 sayılı Spor Kulüpleri ve Spor Federasyonları Kanunu temel olarak, spor kulüplerinin finansal yapılarının güçlendirilmesi, aşırı borçlanmanın önlenmesi ve mali şeffaflığın sağlanmasını hedeflemektedir. Kanun ayrıca spor kulüpleri ile spor anonim şirketleri için “denk bütçe oluşturma zorunluluğunu da içermektedir. Bu zorunluluk, zamanla spor kulüpleri ve spor anonim şirketlerinin mevcut borç yükünden kurtulmalarına yardımcı olabilecektir. Bu çalışmada, hem 7405 sayılı Kanun çerçevesinde spor kulüpleri ve spor anonim şirketlerinin tabi olduğu mali düzenlemeler analiz edilmekte hem de aşırı borçlanmayı önlemeye yönelik hükümler ayrıntılı bir şekilde ele alınmaktadır.

    Yapay Zekâ ve Vergi İlişkisi

    1956 yılında Dartmouth Konferansı’nda temeli atılan yapay zekâ, yıllar içinde çeşitli aşamalardan geçerek gelişmiş ve artık ileri seviyeye ulaşarak yaşantımızın vazgeçilmez bir parçası haline gelmiştir. Yapay zekâyı sadece bir “teknoloji” olarak değerlendirmek ve onu bilgisayar, ma-tematik, mühendislik gibi alanların konusu olarak sınırlandırmak doğru bir yaklaşım değildir. Yapay zekâ; hukuk, felsefe, sosyoloji gibi sosyal bilimlerde de önemli rol oynamaktadır. İçinde bulunduğumuz dönemde toplumsal hayatı şekillendiren en önemli faktörlerden birisi yapay zekâdır. Yapay zekâ ve hukuk arasında göz ardı edilemez bir ilişki bulunmaktadır. Teknolojideki hızlı gelişmeler hukuk sistemlerini etkilemektedir. Hukuk sistemlerinin, hem bu teknolojik imkânlardan yararlanması hem de bu teknolojilerin güvenilir bir şekilde etik değerlere ve hukuki düzenlemelere uygun olarak kullanımını sağlaması gerekmektedir. Özellikle vergi hukuku ile yapay zekâ ilişkisi, birçok farklı boyutta ele alınabilecek oldukça geniş bir konudur. Çalışma ile yapay zekâ ve vergi ilişkisinin ele alınması, konuyla ilgili olarak yapay zekânın sunduğu fırsatların değerlendirilmesi ve getirdiği olumsuzlukların irdelenerek bunları giderici çözüm önerilerinde bulunulması amaçlanmaktadır.

    Türk Hukuku Uyarınca Yabancılık Unsuru Taşıyan Birlikte Var Olma Sözleşmesinden Doğan Borç İlişkilerine Uygulanacak Hukukun Tayini

    In general, the fact that trademarks containing the same or similar signs or names can exist in the same market is primarily among the reasons for rejection in trademark registration. However, the safe way for two competing trademarks to continue their commercial life in the same market is for them to conclude a coexistence agreement. A coexistence agreement is a contract in which the rights of two trademarks owners on the same or similar trademarks are mutually determined and recognized, and in which they can exist together in a certain market or markets. The parties can peacefully coexist in different markets by agreeing on geographical limitations for certain goods and services, without violating each other’s area. For example, a fabric brand registered in Turkey and a bag brand registered in France with the same name conclude this contract with each other. In this example, the foreign element is the registration of the trademarks in different countries. In our study, it is aimed to determine the law to be applied in case the disputes arising from the coexistence agreement containing the foreign element are brought before the competent international Turkish court.

    Türk Devletleri Teşkilatı’nda Cari Denge Sürdürülebilirliğinin Değerlendirilmesinin: Eşikli Doğrusal Olmayan Bir Analiz

    This paper examines the sustainability of the current account balance among countries in the Organization of Turkic States (OTS) from 1991 to 2023, employing both traditional linear unit root tests and the more recent KSS and TAR nonlinear stationarity procedures. The results show that each country’s current account balance follows a threshold (regime-dependent) stationarity pattern rather than a simple unit root process, suggesting that standard, uniform policy prescriptions may be inadequate. Consequently, implementing a differentiated policy framework—tailored to low-, medium-, and high-risk scenarios—could enable more effective management of external imbalances and foster sustainable economic growth across OTS member countries.
